If I've interpreted the rules correctly Philly has won the claim. Cleveland has until  8/23/13 at 06:01:16 PM to make a deal or revoke the waiver

All teams have 72 hours to make a claim.  The 72 hours for claims ended at August 22nd at 6:39:11 PM EST.

The Indians and Phillies have another 72 hours beginning at 6:39:11 PM EST August 22nd to agree on a trade.   They have until August 25th at 6:39:11 PM EST to complete a trade.

Angels won the claim since they are the team with the worst record in the AL. Paul was correct on the times. The Angels and Indians have until August 25th at 6:39:11 PM Est to complete a trade, rescind the waiver or the angels get Votto.

The Phillies win the claim under the current rule:

3) If a player isn't claimed by any team in either league, he can be traded until the end of the month to anyone.
 If a player is claimed, but only by one team, the player can be traded only to the team that claims him.  If a player is claimed by more than one team, the club with the worst record in that player's league gets priority (player's league has priority over other league) -- and the player can be traded only to that team.

In FGM Joey Votto is on the Cleveland Indians, an AL team, therefore AL teams have preference. This does not go off of what league in the real life MLB he is in.

You are correct.  I was thinking about the wrong Ohio team.
