Players from unowned teams will be signed to contracts by moderators as long as roster and cap space are available. For all owned teams players will be released on January 15th if not signed to a contract extension. I suggest that the teams who currently own the players rights re-sign them. Look for updates in the upcoming week.

Is it legal to allow  players to go to FA and them be resigned by the same team at what the FA market dictates?

Yes but you always run the chance in free agency of over paying for a player
