There was a precedent set with AJ Ellis...remember Roy? He is currently on your roster and not on the Blue Jays... Berry goes back on the block to the next highest bidder...Pods - OU is responsible for since there wasn't a previous bidder...OU has also been made aware that he will be losing draft picks because of his FA indiscretion.

And Wily Mo didn't put you over the cap...you just didn't want him anymore...so technically by your argument I should strip AJ Ellis from your roster and add him to the Jays...is that what I am to understand Roy?

It was my understanding that Ellis was taken from the former owner due to extenuating circumstances beyond finances that I believe should remain private out of respect to the parties involved.

Ellis was put back into bidding because the owner couldn't cover the check, and did not within a week after being asked to do so. So rather than pick and choose who to drop, it was decided that it was best to offer Ellis back to the league. That owner lost a draft pick because of his excessive bidding. It is the same situation here. OU has paid his fine via picks, and dropped players to get to cap (almost), Berry will be added back to bidding. Since there are no other bids on Pods, OU is responsible for that contract. Those owners, in on Berry, will be given the opportunity to have their bids validated or not. Much in the same way the Ellis situation presented itself. 

Unfortunately this is a situation that has only presented itself twice in which punishment has had to be doled out, and I do not enjoy it. I understand that one can lose track of their finances, and this has been considered when deciding on the measures taken in both cases. I have also discussed this with the two league commissioners and they agree with the actions that will be taken.

Adding Torres back to your roster will add an additional one million to your most recent roster posting. Leaving you +1.5 mil.  You still have to cover Podsednik +.5...should you choose to keep Berry + 1.5, then you need to cover him as well.

so you would have to clear an additional 2 mil, 3.5 if you want Berry
